These Terms and conditions in which Almanal Trading Company Ltd., ( “Almanal”, “CARAZAH”, “WE”, “US”, “OUR”, “COMPANY”), a Saudi company registered in Riyadh with CR# 1010251942 offers you ( “you”, “your” “customer”, “user”) access to CARAZAH.COM ( “site”, “service”) and its related services. By browsing CARAZAH.COM or using its services you are agreeing in full to all terms and conditions refer to as (the “agreement”) set out below. If you disagree with any of the below terms and conditions “agreement”, you must immediately stop using or accessing this site. We reserve the right to, in our sole discretion, amend these terms and conditions at any point, for any reason. We retain the right, in our sole discretion, to prevent access to our site or service at any point, for any reason.

ELGIBILITY

You must meet with all following conditions to be allowed to use CARAZAH website, chats, and all related services:

• User of age 18 years and older
• Residence of the Kingdom of Saudi Arabia
• Can lawfully enter into legal agreement
• If you sign up on behalf of a business entity, you confirm you are authorized from your business entity and you may lawfully bind that entity into legal agreement.

CARAZAH reserve the right to decline, suspend, delete and terminate services to any user at any time without notice.

DATA COLLECTED

CARAZAH collects the following data that will be used according to our Privacy Policy which user is accepting alongside these terms and conditions. Data such as name, email, phone numbers, addresses, locations and other information related to serving the customer.

USE OF SITE

By browsing or registering as a member of the site, you agree to:

• Allow preprogrammed locations access and notifications receiving from the CARAZAH.
• Provide accurate and true information about yourself and you will promptly inform us of any changes to such information in your account/profile page.
• Not to disclose your personal information to anyone and inform us immediately of any unauthorized access to your account.
• Not to use someone else account or personal information at any time without permission from the account holder.
• Not to violate any laws, third party rights or our rights.
• Not to post false, inaccurate, misleading, insulting, or illegal content.
• Not to take any action that may damage the feedback or the rating system.
• Not to use any of CARAZAH.COM features to distribute spam, computer viruses or any harmful code.
• Not to use, copy, modify or distribute any content from the site and/or our copyrights and trademarks without our permission.
• Not to register or create a new account under your name or borrowed name if the company suspend, delete or terminate your account for any reason. In case you fake or borrowed third party information, we reserve the right to tall all legal actions against you.

DELIVERY

By ordering from CARAZAH you lawfully accept our delivery policy and agree to our delivery schedule and conditions as below:

• Once a delivery time is selected, our delivery team will have a window of one hour before/after the selected slot.
• Upon arrival to the customer selected address, our delivery team will contact you to confirm information and notify you of expected delivery time.
• In case a customer does not answer his phone as provided while ordering within 10-15 minutes, the order will be considered completed and delivered. 100 % charges of the invoice (including VAT) will be applied and the customer has no right to ask for any refund. In this case, the company will seek a better way to deliver the order to the customer on the company free time schedule and the customer will be charged a 50 SR DELIVERY FEES plus 20% of the original order (including VAT) as a waste fee.
• If you order a delivery on a wrong address/location and we deliver the order to that address/location the order will be considered completed and delivered. 100 % charges of the invoice (including VAT) will be applied and the customer has no right to ask for any refund. . In this case, the company will seek a better way to deliver the order to the customer on the company free time schedule and the customer will be charged a 50 SR DELIVERY FEES plus 20% of the original order (including VAT) as a waste fee.
• Our delivery is FREE for all orders above 100 SR (before Value Added Tax – VAT) and we provide NEXT DAY delivery. For orders 100 SR or less (before Value Added Tax – VAT) we charge a delivery fee of 35SR / order.
• Customer has to sign a delivery note, by doing so customer is accepting the delivery and confirming the order delivered is complete and safe. We urge you to check delivered order before signing the delivery note and make sure by yourself it complete and not damaged.
• Damages; In case of receiving a totally damaged, partially damaged or incomplete order you may receive the order and write on the delivery note the issue, take photos of the totally damaged or partially damaged items and contact CARAZAH support team via chats or email to assist you.  In order to be eligible for a full refund you must report those images of the totally damaged or partially damaged items to CARAZAH with 3 hours of receiving the order. The company team will investigate the issue and compensate you by either sending a new order to replace the damaged items FREE of charge or giving the customer a voucher with the same amount that can be used for future ordering or transfer the money to the customer personal bank account.

CANCELATION

At CARAZAH we are striving to provide our customer with fresh and good quality produce. For that we state below our cancelation policy, and by ordering from CARAZAH you lawfully accept this cancelation policy:

• Customer may cancel the order FREE OF CHARGE 24 hours before his selected delivery time or before 12 midnight if his scheduled for next day delivery. Any cancelation that violates these conditions will not be accepted and customer will be 100% charged for the order including VAT (Value Added Tax).
• Customer agree that in case of item unavailability that CARAZAH take out that/those item/items from the order and deliver the remaining items conditionally on having an order value of 100 SR or more before VAT after the elimination of all unavailable item/items.
• Customer may modify the order (adding/removing) before 12 midnight of the scheduled delivery date. For adding items a customer can place a new order and make full payment for it (will not be charged a delivery fee if the order is 100 SR or less before VAT and is combined with an order of value more than 100 SR) and contact our customer service to combine it with a previous order and delivered at one time.
• CARAZAH will not give any cash back or credit returned to any customer after order is placed and confirmed.

RESCHUDLING

By ordering from CARAZAH you lawfully accept the below rescheduling policy:

• Customer may reschedule the order delivery time FREE OF CHARGE 24 hours before selected delivery time or before 12 midnight if order is scheduled for next day delivery.
• In case of rescheduling request less than 24 hours of the selected delivery time or after 12 midnight if order is scheduled for next day delivery, the company will seek a better way to deliver the order to the customer selected other location/ address on the company free time schedule and the customer will be charged a 50 SR DELIVERY FEES plus 20% of the original order (including VAT) as a rescheduling fee.
• Rescheduling availability cannot be guaranteed even if it was requested on the right timing as it will be based on first come first serve.

PAYMENT

CARAZAH.COM will use licensed third party payment gateway to process online payments. An order will be submitted upon receiving payments by credit/debit cards. Only “Cash On Delivery” orders will be processed without any prior payment. Company ensure the security of your Credit/Debit card information used to process a payment. You will be liable to pay Value Added Tax (VAT) on all your orders placed with us. Customer holds company and all its employee harmless for any damages or loses that may resulted from releasing Credit/Debit and personal information to third parties for services provided by the site.

TRADEMARKS

CARAZAH , CARAZAH.COM and related logos, and other words and logos on the Site are either unregistered trademarks or registered trademarks of Almanal Trading Company Ltd. and are protected by international trademark and other intellectual property rights and laws.

INDEMNITY

Customer agrees to indemnify and keep company and its affiliates, officers, directors, employees, suppliers, partners indemnified against any claims, actions, loses and/or suits (including legal cost and expenses) caused by or arising out of using our site, violation of any law, and any other third party in connection with the use of this site.

APPLICABLE LAW

This agreement is entirely governed by the law of The Kingdom of Saudi Arabia. You agree that any claim or dispute you may have against us in relation to this agreement and Privacy Policy will be resolve by a court located in Riyadh. You also agree to contact us directly before filing any claim or suit against us.

WE RESERVE THE RIGHT TO AMEND THESE DOCUMENTS AT ANY POINT, FOR ANY REASON. CHANGES WILL BE POSTED ON THE SITE AND WILL BECOME EFFECTIVE IMMEDIATELY.
